Your privacy is important to us, Folk Magic (hereinafter “Folk Magic” or “we”), and in this policy (“Privacy Policy”) we explain what personal data (“Personal Data” means any data that allows someone to identify you) Folk Magic uses, collects, processes and shares through the website https://www.folkmagic.org (“Site”).

We want you to have complete access to our policies and procedures, so that you may understand the ways you can control how we collect, use, and disclose your Personal Data. We encourage you to read this policy and contact us if you have any questions regarding the data we hold.

General Information

Sharing your data:

Under no circumstances is your data ever sold or rented to a third party.

Folk Magic may share your data in the following circumstances:

to service providers and affiliates (Zoom, Acuity, postal services) who assist in the delivery of products and services
to third parties if Folk Magic believe that disclosure is advisable or necessary to comply with the law, to enforce or apply terms and conditions, or to protect the rights, property or safety of Zhana Levitsky, Folk Magic or others. This may include exchanging information with other companies and organizations for fraud protection and credit risk reduction.
to quickly process your transactions.
to administer a promotion or other Site feature.
to improve our services to you.
to respond to your inquiries related to support, or other requests, and to send promotional
emails to those that request or authorize them.
to track your purchase history and to contact you for account and promotional purposes.

Clients & Customers

What data Folk Magic collects and where it’s kept:

If you engage in 1:1 services Folk Magic collects your name, email address, phone number and questions relevant to the conducting of the session. This data is held within Acuity Scheduling and Zoom.

If you purchase an online course or product, Folk Magic collects your name, email address, phone number, and IP address. This data is held within Squarespace, Square and/or Acuity Scheduling. The privacy policy of third-party companies applies to their collection, use and disclosure of your information.

The purpose for this information:

This basic personal data is needed in order to contact you regarding your product or service, and to monitor your progress.

You will not be added to any other marketing lists unless you have opted in to those yourself. If you are also an email subscriber, please see the Email Subscriber section below to see how your data is used in that context.

How long information is kept:

Your information will be kept until you unsubscribe or notify us otherwise.

Email Subscribers

What data Folk Magic collects and where it’s kept:

We collect your name and email address when you opt in to the email list. This data is held in MailChimp, which is an Intuit company. If you receive email from us, we use certain tools to capture data related to when you open our message, click on any links or banners.

The purpose for this information:

We use this information to stay connected with you through my business, including to inform you about new resources, services, products, and offerings. We have a legitimate interest in understanding how you interact with our communications to you.

How long information is kept:

Your information will be kept until you unsubscribe or notify us otherwise.

Site Users

What data Folk Magic collects and where it’s kept:

FOLK MAGIC.org may collect your IP address and information regarding your location and pages accessed. This data is collected and stored in Squarespace or Acuity.

We use technology to monitor how you interact with our website. This may include which links you click on, or information that you type into our online forms. This may also include information about your device or browser.

We collect information, including your browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to a computer when the Internet is used), domain name, click-activity, referring website, and/or a date/time stamp for visitors.

The purpose for this information:

This data allows Folk Magic to analyze web traffic. This analysis is about general trends rather than you as an individual, and your IP address is encoded and not visible to us. We have a legitimate interest in understanding how you interact with our website to better improve it, and to understand your preferences and interests in order to select offerings that you might find most useful. We also have a legitimate interest in detecting and preventing fraud. We have a legitimate interest in monitoring our networks and the visitors to our website. Among other things, it helps us understand which of our services is the most popular.

How long information is kept:

Your information will be kept until you notify me otherwise; you have the right to be forgotten so contact us if you would like your data to be destroyed.

Cookies and first party tracking

We use cookies and clear GIFs. “Cookies” are small pieces of information that a website sends to a computer’s hard drive while a web site is viewed. We have a legitimate interest in making our website operate efficiently.

Cookies and Third Party Tracking

We participate in behavior-based advertising, this means that a third party uses technology (e.g., a cookie) to collect information about your use of our website so that they can provide advertising about products and services tailored to your interests on our website, or on other websites. We have a legitimate interest in engaging in behavior-based advertising.

Social Networks

If you use any features made available to you on our Site by a third party (i.e, Instagram) it may result in information being collected or shared between us and the third party.

Other Third-Party Service Providers

We may share your Personal Data with companies that perform services for us, such as fulfilling orders, sending postal mail and emails, analyzing customer data, providing marketing assistance, processing credit card payments, investigating fraudulent activity, and providing customer service. If you do not want us to share your information for marketing purposes, simply contact us by email and we will arrange to manually process your order for you, however, we may still send you service and transaction related communications.

Third parties may offer their services directly to you through the Site. In such case, you may be required to agree to the third party’s privacy policy to use the service.

Feedback/Support

If you provide us feedback or contact us for support we will collect your name and email address, as well as any other content that you send to us, in order to reply.

Mobile Devices

We collect information from your mobile device such as unique identifying information broadcast from your device when visiting our website.

We have a legitimate interest in identifying unique visitors, and in understanding how users interact with us on their mobile devices.

Payments

We collect your name, billing address, shipping address, email address, phone number, and credit card number when you subscribe to our Courses and/or Services. We use your information to perform our contract to provide you with our Courses and/or Services.

In addition to the information that we collect from you directly, we may also receive information about you from other sources, including third parties, partners, our affiliates, or publicly available sources.

Use And Processing Of Information.

In addition to the purposes and uses described above, we use information in the following ways:

To identify you when you visit our website.
To provide services.
To improve our service offerings.
To streamline the donation or payment process.
To conduct analytics.
To respond to inquiries related to support, employment opportunities, or other requests.
To send promotional materials, including information relating to our services or promotions.
For internal administrative purposes, as well as to manage our relationships.

Although the sections above describe our primary purpose in collecting your information, in many situations we have more than one purpose. For example, if you complete an online purchase we will collect your information to perform our contract with you, but we also collect your information because we have a legitimate interest in maintaining your information after your purchase is complete so that we can quickly and easily respond to any questions about your purchase. We may also share your information in order to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies, or to comply with your request for the shipment of products to or the provision of services by a third party intermediary.

Service Providers. We share your information with service providers. Among other things service providers help us to administer our website, conduct surveys, provide technical support, process payments, and assist in the fulfillment of Services.

How We Protect Personal Information

No method of transmission over the Internet, or method of electronic storage, is fully secure. While we use reasonable efforts to protect your personal information from unauthorized access, use, or disclosure, we cannot guarantee the security of your personal information. In the event that we are required by law to inform you of a breach to your personal information we may notify you electronically, in writing, or by telephone, if permitted to do so by law.

Some areas of the Site permit you to create an account. When you do you will be prompted to create a password. You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else that has obtained your password, whether or not such access or use has been authorized by you. You should notify us of any unauthorized use of your password or account.

Your Legal Rights

Under certain circumstances and depending on your geographic location, you may have rights under data protection laws in relation to your personal data. These include the right to:

Request access to your personal data;

Request revocation of your consent. If you revoke your consent for the processing of Personal Data, in accordance with this Privacy Policy, then you must immediately discontinue all use of our Site. In some cases, we may limit or deny your request if the law permits or requires us to do so, or if we are unable to adequately verify your identity.

If you wish to exercise any of the rights set out above, please unsubscribe from email correspondence and email us to remove the rest of your information at zhana@folkmagic.org.

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, Folk Magic may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive.

Alternatively, Folk Magic may refuse to comply with your request in these circumstances.

Folk Magic try to respond to all legitimate requests within one month. Occasionally it may take me longer than a month if your request is particularly complex, or you have made several requests. In this case, we will notify you.

If you are not satisfied with our response or believe we are processing your Personal Data not in accordance with the law, and you are in the EU, you can reach out to the Information Commissioner’s Office (ICO).

Children’s Privacy

We do not intentionally collect any personal information from children under the age of 13. If you are under the age of 13, you can look at our Site, but you should not make a purchase, register, or submit personal information to us. If you feel that we have collected data on a child, please reach out to us at zhana@folkmagic.org so that we can take appropriate action.

Users Outside the United States

If you are a non-U.S. user of the Site, by visiting the Site and providing us with data, you understand and agree that the data you provide to us may be processed for the purposes listed in this Privacy Policy. You also understand and agree that the data you provide to us may be processed in the United States. U.S. laws regarding the processing of data may be less stringent than the laws of your country. By providing your data, you consent to this processing.

We may update this privacy policy from time to time by posting a new version on the website. You should check this page occasionally to ensure the changes still work for your needs.
